1. About this policy

1.1 This policy covers our police pickup, consignment and firearm transfer services. It forms part of our Terms of Service and is read with our Storage and Uncollected Goods Policy, which applies to every item we hold for you.

1.2 Each service requires our signed service contract form. The form and this policy together govern the service. If they conflict, the signed form prevails.

1.3 Fees are payable as set out in each section and are summarised in section 5. We may change fees on 30 days’ written notice; changed fees apply to new service periods only.

2. Police pickup service

2.1 Where your firearms are held by NSW Police, we can collect them on your written authority and transport them to our premises for storage, consignment, transfer or return to you.

2.2 The service requires:

• our signed service contract form, which acts as your Letter of Authority for us to collect;
• payment in full of all pickup fees before we attend the station; and
• any additional documentation the police station requires.

For deceased estates, the executor or senior next of kin must sign and provide evidence of their authority (grant of probate, letters of administration, or other documentation we reasonably accept).

2.3 Fees. Call-out fee of $250, which includes collection of one firearm; $50 for each additional firearm collected in the same call-out; $50 for collection of ammunition. Our standard service area covers the North Shore, Northern Beaches, Ku-ring-gai and Ryde/Gladesville areas. Collections outside this area are quoted before booking.

2.4 Collection dates depend on police availability and are not guaranteed. If we attend and police do not release the items for reasons outside our control, the call-out fee covers that attendance and a further attendance is charged as a new call-out. If we do not attend at all, amounts paid are refunded.

2.5 On collection, each item is receipted into our dealer register. The pickup fee includes the first month of storage. Items that remain in storage are governed by our Storage and Uncollected Goods Policy, with monthly fees first billed on the monthly anniversary of the collection date. Items for consignment are governed by section 3; items for transfer by section 4.

3. Consignment sales

3.1 We sell firearms and accessories on your behalf as your agent. You remain the owner until sale. You warrant that you are the legal owner (or authorised by the estate), that the item is free of any security interest, and that it is lawfully registered where required.

3.2 Disclosure. You must tell us in writing about any defect, fault, damage or modification you are aware of. You indemnify us against claims arising from faults you knew of and did not disclose.

3.3 Listing. An advertising fee of $25 covers a 3-month listing in store and online. If unsold after 3 months we will contact you. You may relist for a further 3 months for a $25 relist fee, vary the price, convert the item to storage, or collect it. If we cannot reach you and the item remains with us, storage fees under our Storage and Uncollected Goods Policy apply from the end of the listing period and the uncollected goods procedure applies.

3.4 Price and commission. The listing price is agreed with you in writing. On sale, our commission is $150 where the sale price is under $1,000, and 15% of the sale price where the sale price is $1,000 or more. Commission and any unpaid fees are deducted from the sale proceeds.

3.5 We may accept an offer within 5% of the agreed price without further reference to you. Any lower offer is referred to you for approval.

3.6 The sale completes only when the buyer produces a valid licence and Permit to Acquire and the transfer is recorded with the Firearms Registry. If a sale falls through because of the buyer’s non-compliance, the item is relisted without a further fee for the balance of the listing period.

3.7 Payout. The balance of the proceeds is paid to you by bank transfer within 10 business days after the transfer completes and funds have cleared.

3.8 The buyer’s position. Consignment items are identified as such in advertising and on the buyer’s invoice, which records that we act as your agent. Your name is available to the buyer on request. The buyer’s contract of sale is with you. We are responsible to the buyer for our own descriptions and for any work we carry out on the item. Where the buyer has a claim arising from a fault you did not disclose, clause 3.2 applies.

4. Firearm transfers

4.1 We facilitate lawful transfers of firearms between parties as a licensed dealer, including private sales, interstate dispatch and receipt, and dealer-to-dealer transfers.

4.2 Fees. $50 per used firearm transferred; $100 per new firearm received from another dealer. Fees are payable before the firearm is released and do not include freight, which is quoted separately.

4.3 The transferee must produce a current licence of the correct category and, where required, a Permit to Acquire before the firearm is released or dispatched. We hold a firearm awaiting the transferee’s permit for 30 days without charge. After that, storage fees under our Storage and Uncollected Goods Policy apply until the transfer completes or the firearm is returned to the transferor.

4.4 If a transfer cannot lawfully complete (for example, the permit is refused), we hold the firearm for the transferor’s instructions. Storage fees and, if applicable, the uncollected goods procedure apply.
