1. About this policy

1.1 This policy applies to every item we hold on your behalf, however it came to be with us:

  • goods you have paid for that are awaiting your Permit to Acquire or collection;
  • your own firearms or ammunition stored with us as a storage service;
  • items collected from police under our police pickup service;
  • consignment items that remain unsold at the end of their listing;
  • firearms held for a transfer that has not yet completed; and
  • items left with us for repair, servicing or warranty work.

1.2 This policy forms part of our Terms of Service. Where you sign a storage or service contract with us, that contract and this policy together govern the storage. If they conflict, the signed contract prevails.

1.3 This policy is intended to operate consistently with the Uncollected Goods Act 1995 (NSW). Notice given under section 6 is also given for the purposes of that Act.

2. How we store your items

2.1 Firearms and ammunition are stored in registered safe storage at our licensed premises in accordance with the Firearms Regulation. Each item is recorded in our dealer register.

2.2 Risk and insurance. Goods that we still own (for example, a paid item awaiting your permit) are held at our risk and covered by our insurance. Items that you own (stored items, police pickups, consignment items, repair items) are held with reasonable care but are not insured by us against theft, fire or other loss unless you request and pay for cover in writing. Nothing in this clause excludes our liability under the Australian Consumer Law to provide the storage service with due care and skill.

3. Free periods and storage fees

3.1 The storage fee is $25 per item per month or part month, payable monthly in advance. Discounts for multiple items may be offered under our published tier schedule.

3.2 The free period and any entry fee depend on how the item came to us:

3.3 Storage fees accrue from the day after the free period ends. For purchased goods, we will not charge for any period before we have given you written notice that the fee is starting.

3.4 Accrued storage fees are payable before an item is released to you.

4. Invoicing

4.1 For storage-service and police-pickup items we issue a tax invoice on each monthly anniversary of the date the item entered storage (an item stored on the 14th is invoiced on the 14th of each month). Payment is due on issue.

4.2 For all other items we invoice monthly from the date the fee starts.

5. Your obligations and release of items

5.1 You must keep your contact details current with us, maintain any licence required to lawfully possess the stored items, and notify us immediately if your licence status changes.

5.2 By accepting this policy you nominate the email address you give us as your address for service of notices, and you consent to receiving notices under this policy and under the Uncollected Goods Act 1995 (NSW) by email to that address.

5.3 We release stored firearms only to you in person on production of your current licence and identification, to a transferee under a lawful transfer, or as directed by the Firearms Registry, NSW Police or a court.

5.4 If your licence is suspended or revoked we may be required by law to retain the items or surrender them to police. Storage fees continue to accrue while we lawfully hold them.

5.5 Declared value band. For each item stored as a storage service you must declare which value band it falls into: under $1,000; $1,000 to under $20,000; or $20,000 or more. The declared band determines the notice and disposal procedure under section 7 and any insurance you request. If you do not declare a band, we may assign one based on a reasonable market estimate and notify you.

6. Overdue storage fees

6.1 If a storage invoice is unpaid 30 days after its due date, we will send you a reminder by email and contact you by phone, and flag the account as overdue.

6.2 If the invoice remains unpaid 60 days after its due date, we will issue a formal notice of intention to dispose of the goods under section 7.

7. Uncollected goods

7.1 An item is taken to be uncollected goods if storage fees for it are unpaid 60 days after their due date, or if you fail to collect it after we ask you to in writing.

7.2 Notice. We will give you written notice by email to your nominated address, and by post to your last known postal address, stating: our business name and the address where the item is held; a description of the item; the charges owing; that on or after a date specified in the notice the item will be disposed of unless it is collected and all charges are paid; and that our charges will be retained from any proceeds of sale.

7.3 Notice period and method of disposal, based on the item’s estimated value:

7.4 All disposals of firearms are conducted lawfully through our dealer licence or a licensed auctioneer and recorded with the Firearms Registry.

7.5 From any proceeds we retain the storage fees, notice and disposal costs owing. Any surplus is dealt with as unclaimed money in accordance with law. Any shortfall remains a debt you owe us.

7.6 We keep records of any disposal as required by the Uncollected Goods Act 1995 (NSW) and the Firearms Act 1996 (NSW).

8. Ending a storage arrangement

Either party may end an ongoing storage arrangement by written notice. On termination you must collect your items and pay outstanding fees. Sections 6 and 7 apply to items not collected. Fees paid in advance for a period after collection are not refunded.
