1. About these terms
1.1 These terms apply to use of our website and online store, to purchases made in store, by telephone or online, and to our dealer services (police pickup, storage, consignment and firearm transfers).
1.2 These terms are read together with our other policies, each of which forms part of these terms:
- Payment, Deposits and Orders Policy
- Shipping Policy
- Refunds, Returns and Warranty Policy
- Storage and Uncollected Goods Policy
- Dealer Services Policy (police pickup, consignment and transfers)
- Privacy Policy
Where a policy deals with its own subject in more detail than these terms, the policy applies to that subject. Where you sign a separate service contract with us, that contract prevails over these terms and the policies for the service it covers.
1.3 “We”, “us” and “our” mean Impact Sports AU Pty Ltd (ABN 80 680 499 852) trading as Magnum Sports. “You” means the customer. “Regulated item” means a firearm, firearm part, ammunition, propellant powder, primers, or any other item that may only be supplied to a person holding a licence, permit or authority. All prices are in Australian dollars and include GST unless stated otherwise.
1.4 By purchasing goods from us, engaging a service, or submitting our service contract form, you accept these terms and the applicable policies.
1.5 Nothing in these terms or our policies excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. See section 6.
2. Firearms law compliance
2.1 We are a licensed firearms dealer in New South Wales. Every sale, transfer, storage arrangement and service we provide is conditional on compliance with the Firearms Act 1996 (NSW), the Firearms Regulation, the firearms laws of your state or territory where they apply, and Commonwealth law.
2.2 We will not release or supply a firearm unless you produce a current NSW firearms licence of the correct category and a valid NSW Permit to Acquire for that firearm, and the transfer has been recorded with the NSW Firearms Registry. Payment in full does not, by itself, entitle you to take possession of a firearm.
2.3 Interstate licences and permits are not accepted for the release of firearms in NSW. Interstate purchasers must have the firearm sent to a licensed dealer in their own state or territory under our Shipping Policy.
2.4 We supply ammunition, propellant powder and primers only as permitted by section 65 of the Firearms Act 1996 (NSW). A current interstate firearms licence of an appropriate category is accepted for the purchase of ammunition, powder and primers. Firearm parts and other regulated items are supplied only on production of the licence, permit or authority required for that item.
2.5 Obtaining and maintaining a valid Permit to Acquire is your responsibility. Permits are subject to a waiting period and remain in force for a limited period once issued. Time your application so that the permit is current when your item is ready.
2.6 We may refuse, cancel or suspend any sale or service where we reasonably believe completing it would breach firearms law, where required identification, documentation or authority is missing or appears invalid, or where the Firearms Registry or NSW Police direct us to. If we cancel for these reasons we refund amounts paid for goods not supplied, less costs we have reasonably incurred, as set out in the Payment, Deposits and Orders Policy.
2.7 We are not liable for delay, cost or loss caused by permit or Registry processing times or by a decision of the Firearms Registry or NSW Police.
2.8 You warrant that all information and documents you provide to us (licence details, permits, letters of authority, estate documents) are true, current and complete.
3. Age and entry to our premises
3.1 You must be at least 18 years of age to purchase firearms or ammunition or to engage our services, except as permitted by law.
3.2 Persons under 18 may enter our premises only when accompanied by a responsible adult or with the permission of staff. Staff may ask any person for evidence of age and may refuse entry or ask a person to leave.
4. Prices
4.1 Product prices on our website and in store may change without notice. Once we have accepted your deposit or payment in full, the price of your item is fixed. We will not increase it because of a later supplier price rise, exchange rate movement or freight increase.
4.2 We correct obvious pricing errors in advertising or on our website before an order is accepted. If a corrected price applies to your order, we will tell you before proceeding and you may cancel for a full refund.
4.3 Written quotes are valid for 14 days unless the quote states otherwise.
4.4 Service fees are set out in the Dealer Services Policy and the Storage and Uncollected Goods Policy. We may change service fees on 30 days’ written notice. Changed fees apply to new service periods, not to periods already paid.
5. Website use
5.1 You must not use the website for any unlawful purpose, transmit malicious code, scrape or harvest data, or interfere with the site’s security or operation.
5.2 Content on the site is provided for general information. We correct errors, inaccuracies and omissions when identified. Section 4.2 applies to pricing errors in orders.
5.3 Third-party links and tools are provided for convenience. We are not responsible for third-party sites or their content. This does not affect any rights you have against us for goods or services we supply.
6. Australian Consumer Law and our liability
6.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
6.2 To the extent permitted by law, and except for liability that cannot be excluded (including under the Australian Consumer Law and for death or personal injury caused by our negligence), our liability for any claim arising out of goods or services we supply is limited, at our election, to: for goods, replacement or repair, or the cost of replacement or repair; for services, resupply of the services or the cost of resupply.
6.3 We are not liable for delay or failure caused by matters outside our reasonable control, including police or Firearms Registry processing times, carrier delays, supplier delays, or directions of a regulator.
6.4 You are responsible for the safe and lawful use, storage and transport of goods after they are supplied to you.
7. Your indemnity
You indemnify us against loss we suffer arising from your breach of firearms law, your provision of false or misleading information or documents, or faults in consigned goods that you knew of and did not disclose to us, except to the extent we caused or contributed to the loss.
8. Privacy
We collect personal information, including firearms licence and permit details, to supply our goods and services and to meet our record-keeping obligations under the Firearms Act 1996 (NSW). We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
9. General
9.1 Changes to these terms. We may update these terms and our policies by posting the revised version on our website with a revision date. The version that applies to your purchase is the version current on the date your order is placed. Changes apply to purchases and service periods commencing after posting. Material changes to an ongoing service (such as storage) are notified to you directly with at least 30 days’ notice.
9.2 Ending a service. Either party may end an ongoing service arrangement by written notice. On termination you must collect your items and pay outstanding fees. The Storage and Uncollected Goods Policy applies to items not collected. Obligations accrued before termination survive it.
9.3 Severability. If a provision is void or unenforceable it is severed and the rest of these terms continue.
9.4 Entire agreement. These terms, our policies, and any signed service contract are the entire agreement for the relevant supply and replace prior versions of our terms.
9.5 Governing law. These terms are governed by the laws of New South Wales, Australia. The parties submit to the jurisdiction of its courts and tribunals.
