1. Your rights under the Australian Consumer Law

1.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

1.2 Nothing in this policy excludes, restricts or modifies those guarantees or any other right you have that cannot lawfully be excluded.

1.3 If something goes wrong with goods you bought from us, bring the problem to us. We will not send you to the manufacturer to obtain a remedy that we owe you.

2. Faulty goods

2.1 If goods are faulty, unsafe or not as described, contact us at sales@magnumsports.com.au or (02) 9882 2689, or bring the item to the store. We will assess the item and tell you what remedy applies.

2.2 We require proof of purchase. That may be your tax invoice, receipt, bank or card statement, or our sales record.

2.3 Freight for warranty assessment is at your cost. If the goods are found to have a defect covered by the consumer guarantees, we reimburse your reasonable return freight. See our Shipping Policy, section 5.

2.4 Repaired or replaced items must be collected within 14 days of us telling you they are ready. After that, storage fees apply under our Storage and Uncollected Goods Policy.

3. Manufacturer warranties

3.1 Many products we sell carry a warranty from the manufacturer or the Australian distributor. That warranty is given by them, not by us.

3.2 A manufacturer’s warranty is in addition to your rights under section 1. It does not replace, limit or shorten them. If a manufacturer declines a warranty claim, your rights under section 1 are unaffected and you should come back to us.

3.3 The length, terms and conditions of a manufacturer’s warranty are set by the manufacturer. Some require you to register the product within a set period. We will give you the warranty documentation supplied with your product and tell you what we know of its terms.

3.4 Manufacturer warranties commonly exclude damage caused by hand-loaded or reloaded ammunition, ammunition outside the manufacturer’s published specification, unauthorised modification or gunsmithing, neglect and corrosion, and ordinary wear. Those are the manufacturer’s conditions and we do not set them.

3.5 Where warranty work must be carried out by the manufacturer or distributor, we arrange and manage the return for you. Where an item must be sent overseas, additional permits are required and turnaround can be lengthy. We will tell you what is involved and give you an estimated timeframe before we send anything.

3.6 A firearm sent away for warranty or repair work is handled and recorded in accordance with the Firearms Act 1996 (NSW). We take care of that as part of the process.

4. Second-hand items we own

4.1 Second-hand items that we own and sell as our own stock carry the consumer guarantees described in section 1. For used goods those guarantees are assessed having regard to the age of the item, the price you paid, its condition, and the way it was described to you. A used firearm is not held to the standard of a new one.

4.2 We describe used items accurately and tell you before you buy about any fault, wear or damage we are aware of. The guarantees do not apply to a fault we drew to your attention before the sale.

4.3 We do not offer a separate store warranty on second-hand items. Your rights are the statutory rights in section 1.

4.4 A manufacturer’s warranty usually applies only to the original purchaser and generally does not pass on with a used item. Where a transferable warranty does apply, we will tell you.

4.5 You are welcome to inspect any used firearm and to ask us to function-check it with you before you commit to the purchase. We encourage it.

5. Consignment items

5.1 Some used items are offered for sale on consignment. A consignment item remains the property of its owner until sold. We act as the owner’s agent in arranging the sale; we do not own the item and do not sell it as our own stock.

5.2 A consignment item is identified as a consignment sale in its advertisement and on your invoice, which records that Magnum Sports is acting as agent for the owner. The owner’s name is available to you on request before you buy.

5.3 Your contract of sale for a consignment item is with the owner, not with Magnum Sports. Where the owner is a private individual selling their own property rather than a business, the consumer guarantees in section 1 may not apply to that sale. We will make this clear to you before you buy.

5.4 This does not affect our own obligations to you. We are responsible for what we tell you about a consignment item, and any inspection, servicing, repair or other work we carry out on it is supplied by us and carries the guarantees in section 1.

5.5 We take reasonable steps to confirm the owner’s title before offering a consignment item for sale. We require the owner to confirm in writing that the item is theirs, free of any security interest, and to disclose any defects or faults they are aware of.

5.6 We handle the Registry transfer of a consignment firearm and receive your payment as the owner’s agent. Sections 7 and 8 of our Payment, Deposits and Orders Policy apply to a consignment firearm in the same way as to any other.

6. Change of mind

6.1 We are not required to accept change-of-mind returns. Where we choose to, the goods must be unused, in original undamaged packaging, and returned within 14 days of purchase. The refund is less our actual outbound freight cost, and return freight is at your cost.

6.2 Change-of-mind returns are not available on special, indent or custom orders, ammunition, propellant, primers, or goods that cannot lawfully be restocked.

6.3 This section does not apply to faulty goods.

7. Firearms

Firearms cannot be returned once a transfer has been registered to you, except where required under the Australian Consumer Law.

8. Cancelled orders

Refunds on orders cancelled before delivery, by you or by us, are dealt with in sections 9 and 10 of our Payment, Deposits and Orders Policy. Those sections deal with cancellation by choice or circumstance. They do not apply where goods are faulty, unsafe or not as described.

9. How refunds are paid

Refunds are paid to the original payment method within 10 business days of the refund being approved or the cancellation taking effect.
