At a glance

Paying In full at the time of purchase, unless you are ordering an item in or asking us to hold one.

1. About this policy

1.1 This policy sets out how we accept payment, how deposits and orders work, and what happens if a purchase does not proceed. It applies to every purchase from Magnum Sports unless we agree otherwise in writing.

1.2 This policy forms part of our Terms of Service. Where there is any inconsistency, this policy applies to matters of payment, deposits, orders and cancellation. Storage of items we are holding for you is governed by our Storage and Uncollected Goods Policy. Faulty goods, warranties and returns are governed by our Refunds, Returns and Warranty Policy.

1.3 Nothing in this policy limits your rights under the Australian Consumer Law.

2. How you can pay

2.1 We accept cash, EFTPOS, Visa, Mastercard, PayPal and direct bank transfer. All prices are in Australian dollars and include GST unless stated otherwise.

2.2 We do not apply a surcharge to EFTPOS, Visa or Mastercard payments.

2.3 Payment by bank transfer is not treated as received until the funds have cleared into our account. Goods are not released against a transfer receipt or screenshot.

2.4 PayPal is available for apparel, packs, safes and storage, cleaning and maintenance products, hearing and eye protection, targets, range equipment and other non-regulated goods. A fee may apply to PayPal payments and is displayed before you complete payment.

2.5 We cannot accept PayPal for firearms, ammunition, reloading components, magazines, optics, mounts, knives or other regulated items. PayPal’s acceptable use policy does not permit transactions involving those goods. Use another payment method for these items. We may decline PayPal for any order where we are unsure whether this restriction applies.

2.6 Where PayPal offers you the option to repay PayPal in several amounts over a period, that arrangement is between you and PayPal and does not change your purchase with us. We receive the full purchase price at the time of sale and your purchase is completed in a single payment. Clause 2.5 continues to apply.

2.7 We do not offer payment arrangements, terms or credit of any kind. If you need extended payment options, speak to your bank, your credit card provider or PayPal. Any arrangement of that kind is between you and them.

2.8 We do not accept cheques and do not offer credit accounts to retail customers.

3. Purchases paid in full

3.1 Our standard terms are payment in full at the time of purchase. This applies to all counter sales and to all indent and custom orders under section 6. Where the item is a regulated item, release is also subject to section 7.

3.2 Ownership of the goods passes to you when we have received payment in full and, for regulated items, when the requirements in section 7 have been met.

4. Stock orders and holds

4.1 This section applies where you ask us to hold an in-stock item aside for you, or to order in a standard catalogue item that we or our supplier hold as normal stock. We require a deposit of 50% of the purchase price when the order or hold is placed. Indent and custom items are dealt with in section 6.

4.2 The balance of the purchase price is payable as a single payment within 30 days of the date we notify you that the item is available for you.

4.3 A purchase under this section is completed in two payments only: the deposit, and one balance payment. We do not accept part payments towards the balance and we cannot hold goods on a progressive payment arrangement. If you need longer than 30 days, do not place the order.

4.4 We will notify you by phone, SMS or email at the contact details you give us when the order is placed. It is your responsibility to keep those details current.

4.5 If the balance is not paid within the 30-day period, section 10 applies.

5. What a deposit does

5.1 A deposit secures the item for you and is applied in full towards the purchase price.

5.2 A deposit does not transfer ownership or possession of the goods to you. The goods remain our property and stay in our custody until clause 3.2 is satisfied.

5.3 While goods we own are in our custody they are held at our risk and remain covered by our insurance.

5.4 Where the item is a firearm, we identify it in the order by make, model and condition. The specific serial number is allocated when the transfer is completed.

6. Indent and custom orders

6.1 An indent or custom order is an item that is imported to order, built or modified to your specification, supplied in a special finish or non-standard configuration, or that our supplier will not accept back as normal stock. We will tell you at the time of order if your item falls into this category and confirm it in writing on your order.

6.2 Indent and custom orders are payable in full when the order is placed. No deposit arrangement applies and section 4 does not apply to them.

6.3 Estimated arrival or completion dates are estimates only. Supplier, import, manufacturing and freight timeframes are outside our control.

6.4 Once we have placed the order with our supplier or begun the work, we are committed to the purchase. Section 9 sets out what happens if you decide not to proceed.

6.5 Payment in full does not entitle you to take possession of a regulated item. Release remains subject to section 7.

7. Firearms, ammunition and regulated items

7.1 We can only supply a firearm to a person who holds a current firearms licence of the correct category and a valid Permit to Acquire for that firearm, and only once the transfer has been recorded with the NSW Firearms Registry.

7.2 Payment in full does not, by itself, entitle you to take possession of a firearm. Release is conditional on clause 7.1 being satisfied.

7.3 Obtaining and maintaining a valid Permit to Acquire is your responsibility. Permits are subject to a waiting period and remain in force for a limited period once issued. Time your application so the permit is current when your item is ready.

7.4 Ammunition, propellant, primers, firearm parts and other regulated items are supplied only on production of the licence, permit or authority required for that item.

7.5 We are not liable for any delay, cost or loss caused by permit or Registry processing times, or by a decision of the Firearms Registry.

7.6 We may decline or cancel any sale where we reasonably believe supply would be unlawful, or where required identification or authority is not produced.

8. Collecting your goods

8.1 Once an item is paid for in full, we hold it in our secure storage free of charge for 3 months from the date of payment while you obtain the permit required to take delivery. That period broadly matches the period for which a permit remains in force once issued.

8.2 We can extend the free holding period by agreement in writing. Where a purchase remains with us beyond 3 months, or beyond any extended period we have agreed, storage fees apply as set out in section 3 of our Storage and Uncollected Goods Policy ($25 per item per month or part month). We will tell you in writing before the fee begins and will not charge it for any period before that notice. Accrued storage fees are payable before the item is released.

8.3 If at the end of the holding period you are not able to take lawful delivery, you may:

  • nominate another person who holds the necessary licence and permit to take the transfer; or
  • apply the amount you have paid to another item we have in stock; or
  • cancel the purchase under section 9.

8.4 Items left with us for repair, servicing or warranty work must be collected within 14 days of the date we notify you that the work is complete. After that, storage fees apply under our Storage and Uncollected Goods Policy.

8.5 If goods you have paid for are not collected and no holding arrangement is in place, or storage fees remain unpaid, we deal with them under our Storage and Uncollected Goods Policy and the Uncollected Goods Act 1995 (NSW).

9. If you decide not to proceed

9.1 You may cancel an order at any time before delivery by telling us in writing.

9.2 If you cancel before we have incurred any cost on the order, we refund the amount you have paid in full.

9.3 If you cancel after we have ordered, freighted, modified or otherwise committed to the item, we retain from the amount you have paid an amount equal to the costs and losses we have actually incurred and refund the remainder to you. We will give you a written breakdown of that amount if you ask for one.

9.4 For indent and custom orders under section 6, the costs and losses under clause 9.3 are usually substantial and may equal the whole of the amount you have paid. Where we are able to on-sell the item, we retain only the costs we have incurred and the shortfall between the price you agreed and the price we obtain, and refund the rest.

9.5 If you are unable to complete the purchase because a licence or permit application is refused, delayed or withdrawn through no fault of your own, we refund the amount you have paid less our actual costs. Where the item can be returned to our normal stock without loss, we retain nothing.

9.6 Refunds are made to the original payment method within 10 business days of the cancellation taking effect.

9.7 Clauses 9.2 to 9.5 deal with cancellation by choice or circumstance. They do not affect your rights where goods are faulty or not as described. Those rights are set out in our Refunds, Returns and Warranty Policy.

10. If we cancel an order

10.1 We may cancel an order if:

  • the balance is not paid within the 30-day period in clause 4.2 and remains unpaid 14 days after we give you written notice;
  • you become unable to lawfully take delivery of the item;
  • our supplier is unable to supply the item; or
  • clause 7.6 applies.

10.2 Where we cancel because the balance has not been paid, clause 9.3 applies to the amount you have already paid. The remainder is refunded to you.

10.3 Where we cancel for a reason not caused by you, including where our supplier cannot supply the item or we cease to trade, we refund the amount you have paid in full and retain nothing.

11. Prices and quotes

11.1 Written quotes are valid for 14 days unless stated otherwise on the quote.

11.2 Once we have accepted your deposit or your payment in full, the price of your item is fixed. We will not increase it because of a later supplier price rise, exchange rate movement or freight increase.

11.3 We reserve the right to correct obvious pricing errors in advertising or on our website before an order is accepted. If a corrected price applies to your order, we will tell you and you may cancel for a full refund.

12. Failed payments and chargebacks

12.1 If a payment is dishonoured or reversed, we may pass on any fee our bank charges us and the order is treated as unpaid until the payment is remade.

12.2 If you have a concern about a charge, contact us first. Where a chargeback, PayPal dispute or PayPal claim is raised without contacting us and is later found to be unjustified, we may recover our reasonable costs of responding to it.

13. Trade-ins

13.1 Trade-in valuations are given only after physical inspection of the item and are valid for 14 days.

13.2 You must own the item outright and it must be free of any security interest or encumbrance.

13.3 Where the trade-in is a firearm, the trade-in is not complete until the transfer to us has been recorded with the NSW Firearms Registry. A trade-in value may be applied against a purchase only once that transfer is complete.

14. Changes and contact

14.1 We may update this policy from time to time. The version that applies to your purchase is the version current on the date your order is placed. A copy is available in store and on our website.
